Patenting genes: Justices tackle big health issue

WASHINGTON (AP) ? The Supreme Court seemed worried Monday about the idea of companies patenting human genes in a case that could profoundly reshape the multibillion-dollar biomedical industry and U.S. research in the fight against diseases like breast and ovarian cancer.

Justices argued not only about snipping DNA strands but also about chewing the leaves of Amazonian jungle plants, the shaping of baseball bats and the ingredients of chocolate chip cookies as they tried to figure out whether companies can gain government protection ? and profits ? for their work with human genes.

The ability to claim control of genetic information found inside every American could hang on the nine justices' decision later this summer, a ruling that could affect the intersection of science and the law for years to come.

"The issue here is a very difficult one," Justice Samuel Alito said.

Abstract ideas, natural phenomena and laws of nature cannot be awarded patents, the legal protection that gives inventors the right to prevent others from making, using or selling a novel device, process or application. The U.S. Patent and Trademark Office has been awarding patents on human genes for almost 30 years, but opponents of Myriad Genetics Inc.'s patents on two genes linked to an increased risk of breast and ovarian cancer say such protection should not be given to something that can be found inside the human body.

"Finding a new use for a product of nature, if you don't change the product of nature, is not patentable," said lawyer Christopher Hansen, arguing against the patents. "If I find a new way of taking gold and making earrings out of it, that doesn't entitle me to a patent on gold. If I find a new way of using lead, it doesn't entitle me to a patent on lead."

Several organizations, including the American Civil Liberties Union, the Association for Molecular Pathology, a number of doctors and researchers and some people at risk for hereditary breast and ovarian cancer, have challenged the patents.

But Myriad argues ? and the patent office and a federal appeals court have agreed ? that the company's genes can be patented because the DNA that Myriad isolated from the body has a "markedly different chemical structure" from DNA within the body.

"What was 'merely snipped' out of the body here is fundamentally different in kind from what was in the body," Myriad lawyer Gregory A. Castanias said. "The most important reason it's different in kind is that it cannot be used in the body to detect the risk of breast and ovarian cancers."

The company has used its patent to come up with its BRACAnalysis test, which looks for mutations on the breast cancer predisposition gene, or BRCA. Those mutations are associated with much greater risks of breast and ovarian cancer. Women with a faulty gene have a three to seven times greater risk of developing breast cancer and also a higher risk of ovarian cancer.

Myriad sells the only BRCA gene test. Opponents of its patents say the company can use its patents to keep other researchers from working with the BRCA gene to develop other tests.

In such matters, companies can have billions of dollars of investment and years of research on the line. Their advocates argue that without the ability to recoup their investment through the profits that patents bring, breakthrough scientific discoveries to combat all kinds of medical maladies wouldn't happen. That concerned several justices.

"Why shouldn't we worry that Myriad or companies like it will just say, 'Well, you know, we're not going to do this work anymore?'" Justice Elena Kagan asked.

Hansen said that a company could get recognition for its work and that money for research would always be available, a statement that Justice Anthony Kennedy said wasn't sufficient.

"I don't think we can decide the case on, 'Don't worry about investment. It'll come,'" Kennedy said.

Justices attempted to break the argument down to an everyday level by discussing things like chocolate chip cookies, baseball bats and jungle plants.

Castanias, the Myriad lawyer, argued that the justices could think about the gene question like a baseball bat. "A baseball bat doesn't exist until it's isolated from a tree. But that's still the product of human invention to decide where to begin the bat and where to end the bat," he said.

That didn't work for Chief Justice John Roberts.

"The baseball bat is quite different. You don't look at a tree and say, well, I've cut the branch here and cut it here and all of a sudden I've got a baseball bat. You have to invent it, if you will," Roberts said. "You don't have to invent the particular segment of the strand. You just have to cut it off."

The court moved on to body parts. Said Justice Sonia Sotomayor, "If you cut off a piece of the whole in the kidney or liver, you're saying that's not patentable, but you take a gene and snip off a piece, that is? What's the difference between the two?"

Castanias tried again, comparing the company's patented genes to medicine.

"It's important to note that molecules have been patented for a very long time. That's what drugs are. And drugs are often made by taking one molecule and another molecule, both of which are known, reacting them in a test tube," he said. "Reactions have been around 100 years just like snipping has been, but they make something new and useful and lifesaving from that."

Roberts still wasn't convinced. "Well, I don't understand how this is at all like that, because there you're obviously combining things and getting something new. Here you're just snipping, and you don't have anything new, you have something that is a part of something that has existed previous to your intervention," he said.

That was the ruling of the original judge who looked at Myriad's patents after they were challenged by the ACLU in 2009. U.S. District Judge Robert Sweet said he invalidated the patents because DNA's existence in an isolated form does not alter the fundamental quality of DNA as it exists in the body or the information it encodes. But the federal appeals court reversed him in 2011, saying Myriad's genes can be patented because the isolated DNA has a "markedly different chemical structure" from DNA within the body.

The Supreme Court threw out that decision and sent the case back to the lower courts for rehearing. That came after the high court unanimously threw out patents on a Prometheus Laboratories Inc. test that could help doctors set drug doses for autoimmune diseases like Crohn's disease. The justices said the laws of nature are unpatentable.

But the federal circuit upheld Myriad's patents again in August, leading to the current review.

The court will rule before the end of the summer.

Police: 3 found shot to death inside Kansas home

TOPEKA, Kan. (AP) ? Police say three people have been found shot to death inside a home in Topeka, Kan.

Topeka police Lt. Scott Gilchrist says officers and emergency medical responders arrived after getting a 911 call around 9:15 p.m. CDT Friday from a woman at the home reporting that several people had been shot. He declined to give any identifying information about the three people who were found dead, including whether they lived in the house.

Gilchrist tells the Topeka Capital-Journal (http://bit.ly/10Sm6CZ ) that police were searching for a person of interest. He says the person isn't believed to be a threat to the general public.

The city of Topeka had recorded only two homicides this year prior to Friday, the newspaper reported.

Why Joe Barton's biblical flood comment is so illogical

It's not that Texas congressman Joe Barton cited the Biblical great flood as an example of natural climate change. It's that he misrepresented the arguments of those who say that human activity is changing the climate.?

Spotted by BuzzFeed's Andrew Kaczynski, this video shows Rep. Joe Barton (R-Texas) committing a flagrant straw man fallacy during a hearing on the Keystone pipeline.

One hesitates to leap into a story on this, out of concern that the very act of reading the following quote, uttered by Rep. Joe Barton Wednesday during the Subcommittee on Energy and Power hearing on the Keystone XL pipeline, might actually make our readers less informed.

But the Texas Republican is expressing a misperception about climate science that, though ludicrous, is widespread in political debates around global warming. So, it's at least worth correcting.?

Ready? Here's the quote:?

"I would point out that if you're a believer in the Bible, one would have to say the Great Flood is an example of climate change and that certainly wasn't because mankind had overdeveloped hydrocarbon energy."

OK. Deep breaths.?

It's worth noting that Representative Barton isn't actually saying anything false here. If, as a literal reading of the book of Genesis indicates, the world's tallest mountains were once submerged beneath 15 cubits of floodwater, then, yes, that would most definitely had been an example of climate change. And, if such an event actually occurred, you can't blame fossil fuels.

The preposterousness of Barton's statement stems from his basic fallacy, flagrant?even by Congressional standards, in which he refutes an obviously silly claim held by nobody, and then acts as though he had just refuted a not-obviously-silly claim held by almost every climate scientist in the world.?

Among those climate scientists, you won't find a single one who thinks that our planet's climate has remained perfectly stable right up until the dawn of the hydrocarbon economy. Not one.

In fact, natural climate change in the distant past offers the most precise evidence there is for man-made climate change today. That's why climate scientists spend so much time and effort trying to extract ancient gasses trapped in Arctic ice bubbles or in the calcium carbonate shells of fossilized amoebas on the ocean floor, so that they can better understand the relationship between the composition of the atmosphere and the temperature of the globe.?

It turns out?that lots of things ? not just fossil fuels ? can make our planet go warm or cold, or wet or dry. These include volcanic activity, plate tectonics, meteor impacts, the wobble of our planet as it spins on its axis, magnetic activity on the sun, and even the location of our solar system as it circles the Milky Way.?

And ever since the Earth formed from the solar nebular dust some 4.5 billion years ago, it's been a wild ride. Some 700 million years or so ago, for instance, our planet was a giant snowball, covered in ice. Any liquid water on the surface would have existed only as a thin band around the equator. Much later, about 55 million years ago, it was so warm that the Arctic supported deciduous forests. In the past 650,000 years alone, we've had seven cycles of glaciers advancing and retreating, with the last ice age ending about 7,000 years ago, just as we humans were getting down to the business of creating civilizations for ourselves. ?

So this isn't really about Rep. Barton's views on the Bible. He could have said, "I would point out that if you're a believer in the paleoclimatological record,?one would have to say the?Paleocene?Eocene Thermal Maximum was an example of climate change,?and that certainly wasn't because mankind had overdeveloped hydrocarbon energy," and it would have been equally irrational. No climate scientist is suggesting that the?Earth?hasn't experienced dramatic climactic swings in the past, or that?trilobites?were driving SUVs and using incandescent bulbs.?

What they are saying is that surface temperatures are rising rapidly, and that they have ruled out every known cause except one: human activity. ?

Is it possible that they are all wrong? Of course. Science is never settled. But demonstrating that the most climate scientists are wrong about global warming would require refuting their actual arguments, and not knocking down parodies of their arguments.?

Obama asks Newtown victim's mother to deliver weekly address

UPDATED 3:13 pm ET

Instead of delivering his weekly address to the nation, President Barack Obama has asked Francine Wheeler, whose son was killed in the Dec. 14 mass shooting in Newtown, Conn., to deliver the remarks, which will air Saturday.

Obama personally tweeted the news after it was first announced by White House press secretary Jay Carney at Friday's briefing:

Family members of the 20 children and six educators killed in the mass shooting at Sandy Hook Elementary School last December have been lobbying lawmakers in Washington, D.C., this week to pass legislation to reduce gun violence. Their work has been credited with preventing a bill to expand background checks for gun purchases from being blocked by a Senate filibuster.

The president "believes their voices and resolve have been critical to the continued progress we've seen in the Senate," Carney said of the families.

Carney said this was the first time during the Obama administration that someone other than the president or vice president has been asked to deliver the weekly address.

Prisoners, guards clash over Guantanamo Bay raid

(AP) ? Months of increased tension at the Guantanamo Bay prison boiled over into a clash between guards and detainees Saturday as the military closed a communal section of the facility and moved its inmates into single cells.

The violence erupted during an early morning raid that military officials said was necessary because prisoners had covered up security cameras and windows as part of a weekslong protest and hunger strike over their indefinite confinement and conditions at the U.S. base in Cuba.

Prisoners fought guards with makeshift weapons that included broomsticks when troops arrived to move them out of a communal wing of the section of the prison known as Camp 6, said Navy Capt. Robert Durand, a military spokesman. Guards responded by firing four "less-than-lethal rounds," he said.

There were no serious injuries from the rounds, which included a modified shotgun shell that fires small rubber pellets as well as a type of bean-bag projectile, said Army Col. Greg Julian, a spokesman for Miami-based U.S. Southern Command, which oversees the prison at the U.S. base in Cuba.

"I know for sure that one detainee was hit but the injuries were minor, just some bruises," Julian said.

The confrontation came a day after a team from the International Committee of the Red Cross finished a three-week visit to Guantanamo to meet with prisoners and assess conditions.

"The ICRC continues to follow the current tensions and the hunger strike at Guantanamo very closely and with concern," spokesman Simon Schorno said. "If necessary, an ICRC team will in coming days return to Guantanamo to assess the situation of the detainees on hunger strike in view of this latest development."

Camp 6 had previously been a section of the camp reserved for detainees who followed prison rules. In exchange they were allowed to share meals and pray together, have nearly round-the-clock recreation time as well as access to satellite TV, computer games and classes. It held a majority of the 166 prisoners at the base before the hunger strike began, but the military said the number was down to fewer than 70 on Saturday.

The guards moved the hunger strikers and all other detainees at the communal section to single cells in a separate wing of Camp 6 around 5 a.m. Prisoners will eventually be allowed back into communal living conditions in the future if they follow rules, while hunger strikers will be held in single cells, Durand said.

"For now, housing detainees in individual cells will enable us to observe them more closely," he said.

Tensions had been high at the prison for months. Lawyers for prisoners said a hunger strike began Feb. 6 in protest over their indefinite confinement and what the men believed were tighter restrictions and intrusive searches of their Qurans for contraband. Prisoners offered to give up the Muslim holy book that each one is issued by the government but officials refused, considering it a tacit admission of wrongdoing.

"This is exactly the opposite of what they should be doing," Carlos Warner, a federal public defender in Ohio, said of the decision to move prisoners into single cells instead of negotiating an end to the strike. "The military is escalating the conflict."

The military said 43 prisoners were classified as hunger strikers under a definition that includes missing nine consecutive meals. Lawyers for prisoners have insisted the strike is much more widespread and say almost all of the men are refusing to eat.

Officials were also concerned that some men were surreptitiously starving themselves to avoid being classified as hunger strikers and force fed. The military said it was conducting individual assessments of all the prisoners.
