Vinnie Maliakkal Is Proud of His Academic Achievements | EzinePR

Individuals like feeling accomplished and being recognized for their accomplishments. This holds true even in an academic sense where when a child is recognized for a good grade, they feel a drive to continue their academic achievement in order to achieve more recognition. For pupils who achieve academic success, part of being recognized and rewarded for their capabilities and dedication to understanding comes in the type of having their name mentioned such as an honor roll student.
Being part of the honor roll in highschool might not appear a huge accomplishment when somebody is applying for their job outside of school, yet as a student, it could set precedence for further academic achievements. And Vinnie Maliakkal discovered that this was true for himself. As a highschool student Vineeth Maliakkal wasn?t just an honor roll student at Nazareth Academy in LaGrange, Illinois, but he achieved a score of 100% on a 2007-2008 standardized math test. His accomplishments as a high school student drove him to be equally effective as a student when he initiated attending university.
Vinnie Maliakkal has been attending the University of Missouri for three years now. And he hasn?t only focused on his academic work, but he has also become actively involved in extracurricular activities around campus too. One of the positions that Vineeth Maliakkal holds on his university campus is as a student ambassador. This position on campus is part of the Mizzou Student Foundation, which promotes the idea of private donation and school involvement. Since he holds the position as a student ambassador, there?s little doubt that he excels in his university coursework just as much as he did in highschool. And Vinnie Maliakkal?s good performance in his university work will show employers how smart an individual he is.
Vineeth Maliakkal understands the advantages of living a healthy and active life-style. As a highschool student attending the Nazareth Academy in LaGrange, Illinois, Vinnie Maliakkal was proud to be a student athlete. As a highschool student, he had to find the balance between doing well in school and doing well in sports, yet he did so spectacularly. Vinnie Maliakkal was both an honor roll student and earned a priceless player award through his involvement in track and field.
Vinnie Maliakkal participated in track and field via Hinsdale Central and knew how essential it was to eat healthy and holiday in shape. The training that Vinnie Maliakkal had to perform in order to perform well taught him that so as to stay healthy and fit, a person has to maintain a routine. If a person gives up their health routine, it becomes more difficult to go back into it.
Now, as an university student, Vineeth Maliakkal is active in other methods. He goes out and participates in several extracurricular activities and leads an extremely social life. All his time spent being active and hanging out with friends or working around campus keeps him physically active and academically involved.

Goodnight Seattle! Man, we sure had a blast at last night's reader meetup. The party went down at the Showbox Theater, right across the street from the city's fishy Pike Place Market. Droves of Emerald City Engadget readers braved the drizzle to hang out, talk tech and win some of the year's coolest gadgets -- including a brand new Microsoft Surface RT (yes, it came with a keyboard), a Nexus 7 and a pair of Kindle Fire HDs. We learned a lot of valuable lessons: everything's better with a green screen, people want to know where we go sweater shopping and Seattle's gadget geeks don't really know all that much about the Wu Tang Clan. World shares see modest rise as U.S. storm impact assessed

LONDON (Reuters) - World shares rose modestly in subdued trading on Tuesday as investors waited to see the full impact of a massive storm that wrought destruction across the eastern United States.

The monster storm, code-named Sandy, was responsible for at least 15 deaths, left millions without power, and has closed much of New York's financial district.

Wall Street shut for a second day, and bond trading was also halted as the focus switched to whether markets would be able to resume activity on the final day of the month on Wednesday, which is key to pricing investment portfolios.

The FTSEurofirst 300 index of top European shares was up 0.75 percent at 1,101.75 points and, after gains earlier in Asia, the MSCI world equity index had risen 0.3 percent to 328.86 points.

U.S. stock index futures, which kept trading in Europe, edged lower, but volumes were very light.

"We're a bit lost without Wall Street, frankly," said Alexandre Tixier, technical analyst at TradingSat, in Paris.

Across European stock markets, attention was on corporate earnings, with results from well known names like Germany's Deutsche Bank , Swiss banking giant UBS and oil major BP lifting prices. UBS shares leapt over four percent as it confirmed a plan to cut 10,000 jobs.

Britain's FTSE 100 index was up 0.75 percent, Germany's DAX index up 0.9 percent and Switzerland's SMI index up 0.5 percent.

MODEST BOJ MOVE

In the currency markets, which remained open, the dollar lost ground against a resurgent yen after the Bank of Japan eased policy less aggressively than had been hoped for at its regular policy setting meeting.

The BOJ increased its monetary stimulus for a second month running, this time by 11 trillion yen, disappointing many who had positioned for a more aggressive increase.

"It was a very sceptical response to the BOJ policy meeting, made worse by the fact they have revised lower the growth and inflation outlook," said Jane Foley, senior currency strategist at Rabobank. "That has seen the yen unwind a lot of the softer tone we saw going into this meeting."

The dollar hit a one-week low of 79.25 yen and was down 0.3 percent against a basket of major currencies at 79.67 points.

The weaker dollar helped the European common currency climb 0.4 percent to $1.2958, while news the Spanish economy had shrunk slightly less than expected in the third quarter and Italy's borrowing costs had fallen also supported the euro.

But gains for the single currency are expected to be limited by continuing questions over whether Greece can agree a deal with its creditors, and when Spain might request financial aid.

Spain's economy contracted for a fifth straight quarter between July and September, and prices rose, according to new data, keeping pressure on the government to take some action as the prospect of further civil unrest grows.

"Spain's economy is suffering terribly, which will continue to hit government revenues, and a modest decline in bond yields will not solve the problem," said Kit Juckes, strategist at Societe Generale.

Prime Minister Mariano Rajoy has maintained an ambivalent stance towards applying for a politically embarrassing rescue that would kickstart an ECB bond-buying programme and ease financing costs.

Investors, too, seem willing to wait; 10-year Spanish bond yields were little changed at 5.67 percent.

German government bonds, the benchmark of European fixed-income markets, were also mostly flat.

Italy was even able to sell 7 billion euros of new five- and 10-year government bonds at its lowest cost since May 2011.

Italian 10-year yields dipped 1 basis point lower on the day to 5 percent, having risen about 25 basis points in the last two weeks.

OIL FLOATS

In oil markets, prices were edging higher as traders awaited news of the damage inflicted by Sandy on refineries and pipelines on the U.S. east coast, though weaker demand from the storm-hit region capped gains.

Brent crude for December rose 8 cents to $109.36 a barrel, recovering from a fall to $108.75 earlier, while U.S. crude for December was up 60 cents at $86.14.

U.S. gasoline futures were little changed at $2.7530 a gallon, after climbing more than 5 cents on Monday on expectations of tighter supply.

"People are just holding back a little bit to see if there's any real damage and impact, and at the moment it's too hard to see," said Bjarne Schieldrop, an analyst at SEB in Oslo.

EMC to Acquire Silver Tail Systems - Arik Hesseldahl - News ...

Data storage giant EMC just announced that it has reached a deal to acquire Silver Tail Systems.

This is the privately held company that specializes in detecting fraud on the Web, and the reason that venture capitalist Marc Andreesseen was speaking so highly of security companies when he spoke at D: All Things Digital in 2011. His firm, Andreessen Horowitz, led Silver Tail?s $20 million B round.

Financial terms of the deal are not being disclosed, and EMC says it won?t be material to the 2012 fiscal year.

I just got off the phone with Scott Weiss, the partner at Andreessen Horowitz who led the firm?s investment. Weiss, you may remember, is the founder of IronPort Systems, now part of Cisco Systems, and became a partner at AH in March of 2011. He?s also a director at Silver Tail.

Silver Tail, he says, will essentially become part of RSA, the security branch of EMC that operates more or less independently within EMC.

Weiss told me that when AH made its investment, Silver Tail had about a dozen employees, two paying customers, and a lot of promise. ?I made 10 reference calls before doing the deal, and the customers made sure I knew they were not on the fence,? he said. ?Some even told me they thought Silver Tail was charging too little.?

That?s not a bad sign. So, what does Silver Tail do, anyway? Banks and insurance companies and Web commerce companies use it to keep track of incoming traffic to their sites in real time, and to distinguish good traffic generated by normal customers from bad traffic generated by criminals probably trying to do bad and shady things that more often than not tend to break the law.

It does this using a form of predictive analytics on live Web traffic, at a massive scale. Among the ways to tell good guys from bad are the speed with which they move from one page within a site to another, and the kinds of data they look for. Traffic that?s outside the norm gets flagged for additional scrutiny. Given that the normal patterns are known, there are almost never any false positives. Weiss told me that Silver Tail?s customers include Merrill LynchE-trade and Citibank.

Update: So I?m hearing from sources familiar with the deal that the purchase price was the neighborhood of $300 million to $400 million. I?m going to try and narrow that down a little bit.

Also I just got off the phone with Silver Tail CEO Tim Eades and RSA CEO Art Coviello. Here?s a few more details on the deal. Eades is calling it a ?match made in Heaven,? in part because of RSA?s knowledge in understanding the specific needs and buying patterns that large enterprises have when it comes to security.

Coviello, who essentially runs RSA as an all-but-independent company within EMC says thats how Silver Tail will run initially. ?At RSA we take the same Hippocratic Oath-like approach that EMC does with acquisitions, that of ?first do no harm.? Silver Tail has tremendous momentum and we?re certainly not going to upset that,? he told me. ?That said, we have a specialized sales organization that understands the unique uses cases of the Silver Tail technology.?

Here?a hint at what kind of momentum. Eades told me that SilverTail had recently deployed its product with a ?large bank,? with 21 million customers. It had deployed its product fully within two days. Not bad.

Workshop on spectroscopic techniques for actinides research in Dresden, Germany, from Nov. 5 - 7, 2012

Research on radioactive heavy metals in environmental systems considers diverse tasks, e.g. restoration measures for contaminated industrial fallow grounds, the safe storage of chemical-toxic and radioactive waste, carbon dioxide sequestration to reduce green-house gas emissions as well as the construction and operation of deep geothermal power plants. The research activities are based, on the one hand, on experimental investigations; on the other hand, theoretical modelling is of great interest.

According to Katharina Mller from the Institute of Resource Ecology at HZDR, there has not been much overlap so far between theory and experiments in this field, although they often give complementary information and, hence, they can contribute to a better understanding of the behaviour of heavy metals in the environment. Together with Robin Steudtner and Satoru Tsushima, she is organizing the new workshop, which hopefully will bundle and strengthen the respective research activities and act as a nucleus for an international network.

The first international workshop "Advanced Techniques in Actinide Spectroscopy" (ATAS) at the Helmholtz-Zentrum Dresden-Rossendorf will take place from November 5 to 7, 2012. The organizers are expecting about 75 scientists from Europe, the US, Australia, Japan and China. They are satisfied with the interest in the kick-off workshop: "It seems that we hit a nerve for more intense scientific cooperation in this area".

The workshop consists of seven sessions with oral and poster presentations by international scientists. Furthermore, guided tours to the radiochemical labs and other research facilities at HZDR are offered to the participants. The workshop is supported by the German Research Foundation (DFG), the European research network "Actinet i3", the German Federal Ministry for Education and Research (BMBF) and by partners from industry.

Lions top Seahawks 28-24 with 20 seconds left

DETROIT (AP) ? The Detroit Lions drafted Titus Young last year, envisioning him as the receiver to eventually replace veteran Nate Burleson.

It has happened sooner than planned, and Young is making the most of his opportunity.

Young caught his second touchdown pass from Matthew Stafford on a 1-yard slant with 20 seconds left, lifting Detroit to a 28-24 win over the Seattle Seahawks on Sunday.

"Matthew trusted me all day, and he gave me a perfect opportunity to make a play at the end," Young said. "I wanted do that for everyone on the team, but I especially wanted to do it for Nate."

Burleson broke his right leg in Monday night's loss at Chicago, pushing Young up the depth chart. Burleson sent a motivational message to his teammates on offense that was shown on video Saturday night.

Young caught a go-ahead TD midway through the second quarter and finished with nine receptions and 100 yards receiving ? both career highs ? in a breakout performance that didn't surprise Detroit coach Jim Schwartz.

"I wasn't worried about Titus," Schwartz said. "Titus has never lacked for self-confidence."

Young needed to make the second TD catch after Zach Miller had a spectacular, 16-yard snag on a toss from Russell Wilson with 5:27 left that put the Seahawks ahead.

But Seattle (4-4) couldn't stop the Lions (3-4) on their last possession.

"We're disappointed that after that terrific drive, we couldn't finish it off the way we wanted to," Seattle coach Pete Carroll said. "We didn't get the stops on third down."

That was a problem for the Seahawks all afternoon, giving up first downs on 12 of 16 third downs on defense, including three on Detroit's last drive.

Stafford led the 16-play possession that started at Detroit's 20 with 5:27 remaining. It began with a 15-yard pass to Calvin Johnson and was kept alive with third-down conversion passes to Johnson in Lions territory, to Joique Bell that set up the winning score from just outside the goal line on another third down.

After Stafford had to throw away two passes to avoid sacks with no timeouts left, Young broke inside of cornerback Brandon Browner and caught the winning TD pass.

"There were four dudes standing next to Calvin and one standing next to Titus, so I liked my odds on that side," Stafford said. "Calvin got a lot of attention all game, just like he always does, but the other guys stepped up. Titus had a huge game, Brandon Pettigrew had a hell of a game, Ryan Broyles made some big plays, and the running backs were coming out of the backfield and making catches.

"That's what we needed."

Stafford threw a winning TD pass with less than a minute left for the second time this year and for the fourth time in four seasons. He has led nine drives ? including three this year ? that led to decisive winning scores in the fourth quarter and overtime during his 36-game career.

"It's easy to be confident in Matt when you are with him every day," Schwartz said. "The talent he has isn't just going to go away."

Stafford was 34 of 49 for 352 yards with three TDs, also connecting with Broyles in the end zone at the end of the first quarter. The quarterback also ran for a 1-yard TD that gave Detroit a lead early in the fourth period for the first time this year.

It looked like the Lions were going to blow it.

Seattle went ahead when Wilson lobbed a pass into the end zone that a leaping Miller tipped to himself with his right hand and hauled in with both hands for the go-ahead TD.

"I knew he'd catch it," Wilson said. "He has unbelievable hands."

Seattle, though, was the team that failed to hold onto the lead and ended up losing consecutive games for the first time this year.

Wilson was 25 of 35 for 236 yards with two TDs and an interception. Marshawn Lynch ran just 12 times for 105 yards, including a career-high 77-yard run early in the second quarter for one of five lead changes in the closely contested game.

Sidney Rice had six receptions for 55 yards and a 9-yard score that put Seattle up 17-7 early in the second quarter.

Young's first score, catching a 46-yard pass in stride from Stafford, started Detroit's comeback on the ensuing possession. His second one sealed the much-needed victory for the Lions.

"Huge win," Detroit defensive end Cliff Avril said. "I'm just glad we pulled it out because 2-5 is a bigger hole than 3-4."

NOTES: Lions S Louis Delmas injured his left knee, which was surgically repaired in August, and left in the third quarter. "It's the same knee, but I don't know that it is the same injury," Schwartz said. "He'll have tests." ... The Lions left starting LB DeAndre Levy (shoulder) and key CB Bill Bentley (ankle) inactive and Seattle was without reserve WR Braylon Edwards and backup DE Jason Jones inactive. The team said Edwards woke up with a swollen knee and the decision to leave him out was made after he tried to go through pregame warm-ups.

Mystery Micrograph revived, v2.0 chapter 1

Back in the good ol? days on Skeptic Wonder I used to run a little ?Mystery Micrograph? series, where an image or a plate (that?s not immediately obvious without context) would be grabbed from a paper and posted without source, and much agony would ensue over trying to figure out what it is (or some cheater who happens to work on the bug would drop by and ruin the fun ;p). Or sometimes it was immediately obvious to readers. In any case, it seemed like people were having fun! So I?d like to bring back the Mystery Micrographs and hope for a bit of interaction (which I probably haven?t been helping by vanishing for the better part of a year?), and this time ?I?ve got some of my own images to use too (haha, good luck with reverse Google image search on those!). And of course you are allowed to make guesses and ask questions.

Just one little request: if you?ve already seen the image elsewhere or are deeply familiar with the subject from your work? please try to give others a chance first!

??USDOJ: Alleged Trafficker of Counterfeit Automotive Accessories Indicted in Virginia

WASHINGTON ? An alleged trafficker of counterfeit automotive accessories was indicted yesterday by a federal grand jury in the Eastern District of Virginia for allegedly participating in a conspiracy to sell to unsuspecting United States consumers more than $3 million worth of counterfeit General Motors (GM) and Bavarian Motor Works (BMW) automotive diagnostic devices and other automotive equipment, Assistant Attorney General Lanny A. Breuer of the Justice Department?s Criminal Division, United States Attorney for the Eastern District of Virginia Neil H. MacBride, Assistant Director Ronald T. Hosko of the FBI?s Criminal Investigative Division and FBI Atlanta Special Agent In Charge Mark Guiliano announced today.

Katiran Lee, 39, an Indonesian national who allegedly sold the counterfeit goods while he was living in Duluth, Ga ., was charged with two counts of trafficking in counterfeit goods, four counts of wire fraud and one count of conspiracy to commit wire fraud.

According to the indictment, from August 2008 through December 2011, Lee conspired with manufacturers in the People?s Republic of China (PRC) to sell automotive diagnostic devices bearing counterfeit GM and BMW marks to consumers in the United States.? Such diagnostic devices are used by mechanics to identify problems with and assure the safety of motor vehicles employing electronic control systems.? Lee allegedly advertised and sold the diagnostic devices on eBay and through his own website, and had the PRC manufacturers send counterfeit devices bearing unauthorized GM and BMW marks directly to his customers.
?
According to the indictment, during this same period, Lee also advertised and sold over 35,000 counterfeit programmed keys and key fobs for vehicles produced by GM, BMW and numerous other automotive manufacturers, including Chrysler, Honda, Toyota, Audi, Mercedes Benz, Ford, Infiniti, Land Rover, Mazda, Mitsubishi, Nissan, Peugeot, Renault, Subaru, Suzuki, and Volkswagen.? Lee allegedly programmed the keys himself and affixed counterfeit marks to deceive consumers into believing that the products came from the respective automotive manufacturers.

In the indictment, the government is seeking forfeiture of computers, programming equipment and thousands of blank keys and trademarked automotive emblems recovered during a search of Lee?s home on February 22, 2012, and the forfeiture of properties totaling up to $600,000.

The case is being prosecuted by Trial Attorney Evan Williams of the Criminal Division?s Computer Crime and Intellectual Property Section and Assistant United States Attorney Lindsay Kelly of the Eastern District of Virginia and was investigated by the FBI?s Intellectual Property Rights Unit as part of ?Operation Engine Newity,? an international initiative targeting the production and distribution of counterfeit automotive products that impact the safety of the consumer, and FBI Atlanta.

The FBI is a full partner at the National Intellectual Property Rights Coordination Center (IPR Center).? The IPR Center is one of the United States government?s key weapons in the fight against criminal counterfeiting and piracy. The IPR Center uses the expertise of its 19 member agencies to share information, develop initiatives, coordinate enforcement actions and conduct investigations related to intellectual property (IP) theft. Through this strategic interagency partnership, the IPR Center protects the public?s health and safety, the United States economy and the war fighters. How to Bring the Start Menu Back in Windows 8Windows 8 has some pretty cool things going for it, but it's become incredibly controversial because of one major change: the Start menu is completely gone. Luckily, there are a ton of programs out there that bring it back. Here are three of our favorites.

Start8 Fits In Perfectly with Windows 8

Start8 is our favorite of the bunch. For just $5, you get a full-fledged Start menu replacement that fits in with Windows 8's more "flat" theme, though you can also choose a theme with more rounded corners like the old Windows 7 start menu. You can also set the Start button to launch a small version of the Start screen, so you can get the benefits of the Start menu with the features of the new Start screen.

Start8 is also pretty configurable, letting you tweak the size of the icons, choose which shortcuts show up in the menu, and more. You can also tweak which shortcuts bring up which version of the Start menu or Start screen, as well as disable things like Windows 8 hot corners, the Charms bar, and even set Windows to go to the desktop when you first sign in. In short: it does everything you could need with the utmost simplicity, and it doesn't feel out of place. It's the best $5 you'll spend on Windows 8. (Bonus: It works with Soluto, the fantastic remote troubleshooting tool, so you can install it for your friends without them having to lift a finger.)

Classic Shell Is Insanely Customizable

How to Bring the Start Menu Back in Windows 8If it's customizability you want, Classic Shell is the program you want. Classic Shell starts off looking like an old school pre-XP Windows Start menu, but you can switch to a more XP- or 7-style Start menu with the press of a button. Dive into the settings and you can tweak literally every tiny corner of your Start menu, from which shortcuts open the Start menu to which icons show up, what the Start button looks like, what the search box can look for, the fonts, and a ton more. If you're a hardcore tweaker, this free and open source program is going to make you giggle with glee. Bonus: it's part of Ninite, so you can install it along with all your other favorite programs at once.

Classic Shell also lets you bypass the Start screen, as well as comes with tweaks for other Windows programs like Windows Explorer, Internet Explorer, and more. It'll even bring back some features from the old XP days.

StartMenu8 Is as Simple as They Come

How to Bring the Start Menu Back in Windows 8If the other two options above look just a little too complicated, StartMenu8 may be more your speed. Install it, and you'll have your old Start menu back?that's it. It feels a little different than the others (it's more of a popup than a menu), and it has a somewhat annoying "Send Feedback" button, but it does the job without any complicated configuration menus. The only options it has?when you right-click on the Start button?are to run it at startup and to skip the tiled Start screen. This is the best option if you just want to install something for free and get on with your day.


Start8 is by far our favorite option, but the others are quite good too. You can find a ton of other Start menu replacements out there, but these three should cover you no matter what your needs. Try them all out for yourself and see what you like best?there's something here for everyone.

Copyright case could threaten eBay, garage sales

The U.S. Supreme Court, in a case to be argued Monday, wades into a controversy over federal copyright law that could determine the legal rights of American consumers to sell thousands of used products on eBay and at garage sales and flea markets.

The legal battle involves Supap Kirtsaeng, a student from Thailand who was surprised by the high cost of academic textbooks when he arrived in the U.S. to attend college.? He asked his parents to search bookstores back home and send him much cheaper versions -- published overseas and sold at a fraction of the price -- of the same texts.?

He was soon running what amounted to a small business out of his apartment, helping to pay his way through school by selling textbooks on eBay. The exact amount of his profit is unclear, but court records say it was around $100,000.?

The textbooks his family shipped him each bore this warning: "Exportation from or importation of this book to another region without the publisher's authorization is illegal," but Kirtsaeng wasn't bothered.? He concluded -- based on a search of articles on the Internet -- that he was in no legal jeopardy.??

The first Monday in October is the traditional start of the Supreme Court's new term. ?Last term was a blockbuster, dominated by health care and immigration. But this one looks like it, too, and will be one of the most important in years.? NBC's Pete Williams reports.

The publisher of some of the books he sold, John Wiley & Sons, didn't see it that way. It sued him in federal court, and a New York jury ordered him in 2009 to pay $600,000 in damages.? When he said he had nowhere near that kind of money, he had to hand over personal property, including his computer, printer and golf clubs. A federal appeals court last year upheld the verdict.?

Kirtsaeng was caught between two federal laws, and he's now asking the U.S. Supreme Court to see it his way.

One longstanding provision says when the holder of a copyright offers a work for sale, its legal interest in that specific copy evaporates as the item is sold. It's called the first-sale doctrine, and it means that if you buy the latest John Grisham novel, you can sell it on a website or give it away to the church library without violating copyright laws.?

But another law prohibits importing works "acquired outside the United States ... without the authority of the owner of copyright."? Applying that statue, the federal courts ruled against Kirtsaeng, reasoning that "the first-sale doctrine does not apply to copies manufactured outside of the United States."???????????

A who's who of companies and groups involved in selling used merchandise is urging the Supreme Court to overturn the publisher's victory.?

EBay warns that leaving the ruling intact would be a blow to "trade, consumers, secondary markets, e-commerce, small businesses, and jobs."? Goodwill Industries says the ruling would have "a catastrophic effect on the viability of the secondary market and, consequently, on Goodwill's ability to provide needed community-based services."?

"There are enough copyright owners out there -- and enough crazy copyright lawsuits," says a group of book store operators in a friend of court brief. "No one should be put to the choice of violating the law and hoping they don't get caught, and losing their business."?

The effect of a victory for the publisher, according to some experts in copyright law, would extend far beyond the market for books and other published materials.? It could also affect sales of thousands of used consumer electronic products made outside the U.S. that contain copyrighted software, perhaps even used cars.?

Kirtsaeng's lawyer makes the same expansive claim in his Supreme Court brief.? "Even cherished American traditions, such as flea markets, garage sales, and swapping dog-eared books are vulnerable to copyright challenge" under the appeals court ruling, argues Josh Rosenkranz of New York.

But could that really be the outcome??

"It doesn't mean you'd have industry enforcers attending yard sales. You'd just be converting a bunch of people into law breakers," says Prof. Rebecca Tushnet, an expert on copyright law at Georgetown Law Center in Washington.?

Most likely, she says, music and book publishers would be visiting stores and Internet sites that sell used materials. "Anything more organized, like eBay sales or craigslist could be disrupted," she says.? "And I do think it's a very serious threat. They are very clearly willing to do this."?

Not so, argues Washington, D.C. lawyer Ted Olson, representing the publisher that sued Kirtsaeng. If such predictions were right, he says, "those consequences should already have occurred in response to 30 years of judicial decisions and commentary."?

However the court decides the case, it will undoubtedly affect a category known as graymarket sales, in which middlemen legally buy products overseas, then make them available for sale by retailers in the U.S. who can offer the products for lower prices.??

Swiss watch maker Omega and discount retailer Costco have been battling in court for years over this issue. Omega claimed Costco was improperly selling its watches acquired overseas through just such a graymarket mechanism.?

Omega says its authorized US dealers charge prices "that are higher than the prices charged in other, less developed and less competitive markets."? It argues that any erosion of copyright protection for overseas sales would limit a manufacturer's ability to tailor prices to global markets.?

But discount retailer Costco is siding with Supap Kirtsaeng, saying it "often sells copyrighted products that, although genuine, were not purchased directly from the copyright owner."

Capture of Libyan town smacks of revenge, not reconciliation

TRIPOLI (Reuters) - Hours after taking control of Bani Walid, a former stronghold of Muammar Gaddafi, Libyan militias from the rival city of Misrata fired ferociously at its empty public buildings.

Fighters yelling "Allahu akbar (God is greatest) and "Today Bani Walid is finished" sought to make their mark with gunfire and rocket-propelled grenades on a town they say still provides a refuge to many of the overthrown Libyan leader's followers.

The chaotic, vengeful scenes demonstrated the weakness of the new government's authority over former rebel militias which owe it allegiance but essentially do what they like.

A sign on a bank building that bore the Gaddafi-era name for Libya, "The Great Arab Socialist People's Republic", was scarred with bullet holes. The central streets were empty except for the fighters who filled them with their violent celebration.

"The Gaddafi fighters are out of Bani Walid, they have gone," said Ali Mahmoud, a Misrata fighter in a pickup truck at a central Bani Walid roundabout, patriotic music blaring.

"Some people here still wanted Gaddafi, we have to show them that he is finished."

After days of shelling that sent thousands of families fleeing from the hilltop town in scenes reminiscent of last year's war, militias aligned with the defense ministry, a grouping known as Libya Shield, seized Bani Walid on Wednesday.

The latest fighting, in which dozens of people were killed and hundreds wounded, erupted over a government demand that Bani Walid hand over those who had kidnapped and tortured Omar Shaaban, the former rebel fighter who had caught Gaddafi hiding in a drain in his hometown of Sirte last year.

Shaaban, from Misrata, a city that underwent a harsh siege by Gaddafi's forces, died in a Paris hospital last month from injuries inflicted during two months of captivity in Bani Walid.

The United Nations had called for restraint as militias gathered menacingly around Bani Walid, whose residents had baulked at turning over the wanted men to unruly armed groups, while Libya's justice system remains in disarray.

"There are some wanted people in Bani Walid, and we do want to hand them over but they also have rights," said Murad Mohammed, a student and Warfala tribe member living in Benghazi.

"So do you expect us to give them to militias who do not have legitimacy?"

Many people in Bani Walid belong to the powerful Warfala tribe, which was mostly loyal to Gaddafi.

The town and its now-displaced inhabitants, long isolated from the rest of Libya, fear retribution and wonder what fate awaits them in the post-Gaddafi era.

A disquieting example is offered by Sirte, whose residents feel neglected by Libya's new rulers, saying they are paying the price for being the last bastion of Gaddafi, who was killed there on October 20, 2011. His death has yet to be investigated.

Days later, Sirte residents were blaming vindictive rebels for some of the destruction visited on their city.

While the government has set up committees to tackle security, services and the return of refugees to Bani Walid, militia commanders say they will stay to keep the town "secure".

"Such groups have a background and a certain vision of what Libya should be and it doesn't always necessarily match that of the elected officials at the (ruling) General National Congress," said Claudia Gazzini of the International Crisis Group.

"This risks pushing back the reconciliation attempts that could have been fostered better in a peaceful manner between Bani Walid and the rest of Libya."

"KIDNAPPED CITY"

Bani Walid's predicament underlines the challenge Libya's new rulers face in reconciling groups with long-running grievances and embracing those who chose not to back the revolt - whether out of fear, or because they supported Gaddafi, or because they were benefiting in some way from his rule.

The government knows it must now strike the right balance and not risk storing up trouble for the future.

With 70,000 people, Bani Walid, some 170 km (105 miles) south of Tripoli, was one of the last towns to surrender to rebels last year. Gaddafi's now-captured son Saif al-Islam staged a last stand there before fleeing into the Sahara.

In January, the town grabbed headlines when fighters threw Tripoli's men out of the city, installing its own local council.

In July, fighters from Misrata threatened to attack it after two journalists from their city were detained.

While Misrata fighters have complained at what they call Bani Walid's continued defiance and its alleged harboring of former Gaddafi loyalists, townsfolk there say they have been unfairly tarred with the "pro-Gaddafi" brush.

"Bani Walid became a centre for those who were wanted for justice to escape," government spokesman Nasser El-Manee told a news conference. "We can say that they kidnapped the city."

Rights groups have voiced concern over the conditions of some detention centers run by militias, especially in Misrata.

Some have said this month's assault amounted to revenge by Misrata, whose fighters have been quick to retaliate, sometimes brutally, against towns that have been seen as loyalist. Many of the militias attacking Bani Walid were from Misrata.

"The other problem here is that we have a military action to free men who were arbitrarily detained by Bani Walid, but at the same time we have the same situation in other cities, Misrata first of all," Gazzini said.

"I feel that the congress has sort of followed this intense lobbying attack by the Misratans and by groups of Bani Walid revolutionaries who were kicked out of Bani Walid," she said.

"Now what we are hearing from these spokesmen that they want to take the glory for this inglorious operation."

ACTS OF REVENGE

Army officials said they had freed several detainees in Bani Walid and captured some fighters who used to belong to a brigade commanded by Gaddafi's son Khamis.

Human rights groups have urged the authorities to make clear that looting, beatings and destruction will be prosecuted.

"The government and forces under its command should protect residents in Bani Walid and reject acts of revenge," said Fred Abrahams, special adviser at Human Rights Watch.

"There is an urgent need to stop destruction of the town and begin reconstruction, as well as to prosecute those who broke the law," he said in a statement.

Residents fleeing Bani Walid spoke of no water or power and little food and medicine in the town. There were unconfirmed reports of militiamen entering suburbs with bulldozers.

As in Sirte, many in Bani Walid may feel resentment, believing they have been the victims of collective punishment.

"Where is the international community?" Bani Walid tribal elder Mohammed al-Shetawi said by phone after leaving the town.

"Where is the United Nations and the European Union and the other people in the world, why have they forgotten us?"

Benghazi congress member Saleh Gaouda said the priority of the authorities was to give Bani Walid residents the security to be able to return to their homes.

"It is important to make people inside Bani Walid believe in February 17th," he said, referring to the name given to the 2011 rebellion against Gaddafi. "This can be done through the media, talking, giving them a chance to be part of society."
